[box] WHAT IS A FAILURE TO APPEAR (FTA)??[/box]
You will receive a failure to appear (FTA) if you miss your court date. You can either miss your initial appearance date, extension date, arraignment date, trial date, or any other appearance date.
[box] CONSEQUENCES OF A FTA?[/box]
If you are charged with an FTA for failing to appear at court, the court may impose both a fine penalty and a civil assessment up to $1,000.00. There are three (3) legal excuses for failing to appear in court:
- You were on active duty in the military, or
- You were in the hospital on the scheduled court date, or
- You were incarcerated on the date of your scheduled court date.
You MUST provide proof to the court if any of the above apply.
If none of the above are applicable, we will fight to reduce and/or dismiss FTA penalties and civil assessments on your behalf. In addition, if you have any information regarding the reason why you failed to appear in court, please provide this information to us so we can advocate on your behalf
